The Plaintiff alleged the Emergency Department Physician’s failure to perform a CT of a back fracture resulted in an unnecessary complex back surgery plagued with post-operative complications including a pulmonary embolism, significant scarring, significant long-term pain and a failed suicide attempt.  After a 7-day trial, the jury returned a verdict for the physician.

A 57 year old male claimed that he has over the last 10 years and currently suffers from Chronic Regional Pain Syndrome as a result of the negligence of an Emergency Department Physician’s failure to timely diagnose and treat a lower leg compartment syndrome.  At the end of this three-week trial, the jury rejected his request for $9.5 million and found for the physician.
